“App”: Any app owned by us that is meant for use on mobile communication devices including Smartphone’s and tablets

“Platforms”: Refers to the Site and App collectively

“third party platforms”: Internet sites maintained by third parties. oopsytheclown.com does not control in any respect, or necessarily endorse, the information, content products, services, advertising, or other materials that may be found on the linked site.

This site is intended for use by its digital viewers to provide safe, wholesome, and entertaining content and recognizes the importance of privacy concerns. This Privacy Policy has been implemented for our digital platforms (“Platforms”), and by accessing and using this site (“site”), you agree to this policy on your own behalf and on behalf of minor children under your guardianship. If you do not agree to this policy, please discontinue your access to and use of this site immediately. Through our Platforms, we aim to provide audio, video, downloadable books and other ancillary entertainment products to children and their families. We may collect personal information through either a direct request to you or potentially through anonymous information that may be automatically collected from your computer, phone or other communications device.

Personal Information:

i) Direct Request:

We do not request the submission of personal information about your minor child. You are free to determine whether or not to engage in any activity on our Platforms or submit personal information that can be used to identify or contact you, whether online or offline. This includes your or your minor child’s name, email address, phone number or other information). Please note that most of the activities on our Platforms do not require you to submit any personal information.

If you are asked to submit personal information, we will explain in the sign-up or collection process how we will use the information. For example, an email address may be required when signing up for a newsletter. This information will be used only as stated, other than in Special Circumstances which are described below.

Behavioral advertising is not utilized on our Platforms, meaning that you will not see any advertising that is targeted to you based on your combined activity on our Platforms and other sites.

Third parties contracted to assist with the Platforms are required to follow this Privacy Policy.

ii) Children’s Platforms:

Personal information that may be collected on our Platforms and that may be directed to minor children under the age of 13 is set to follow resolutions passed by Canadian and international privacy and data protection commissioners in 2008 as outlined in the Canadian Regina Resolution, the International Strasbourg Resolution and the United States’ Children’s Online Privacy Protection.

Parental consent will be obtained by us before asking for personal information on our Children’s Platforms unless the request for information falls within an exception that would be permitted under these resolutions and policies. Personal information collected from children is not made publicly available nor do we enable children to do so on our Platforms.

We will not require a child’s participation in any activity or service on the disclosure of more personal information than is reasonably necessary to participate in an activity.

Parents and/or guardians may contact us to review, update or delete any of their children’s personal information that may have been collected and elect that we do not collect any additional personal information from them.

iii)     Anonymous Information:

We may use cookies and similar technologies like pixels and web beacons on our platforms to automatically collect anonymous information that is generated from your devices, such as a computer’s Internet Protocol address, a mobile device identifier, operating system, or general locaters such as a zip or postal code. As a user moves from one web page or screen to another, a cookie (“cookie”) is used to verify that it is the same device. Cookies also keep track of user selections. Devices can be set to accept cookies, which can then be deleted, or devices can be set to not accept them. Be aware that if cookies that have been placed on your device by our platform are disabled, you may not be able to use certain services or features. A web beacon (“web beacon”) may also provide us with information about page usage or e-mail message acceptance. Some information is collected through third-party analytics tools.  Analytical information collected by us as outlined above is used to better understand, monitor, and improve the performance of our Platforms and support internal operations. Individual user information is not made publicly available.

Internal operations support includes:

– Metrics monitoring (eg. total number of visitors/traffic at any given time);

– Landing page analysis (eg. visitor site entrance, pages viewed, frequency)

– Popularity of site activities and services;

– User location (e.g., zip/postal code information);

– Browser identification and adaptation

– Technological diagnostics and repair

Special Circumstances

i) Law Enforcement and Safety: We may access, preserve and share your information when we have a good-faith belief that it is necessary to:

(a) Respond to a legal request (like a search warrant, court order or subpoena) or otherwise to take action because we believe it is required or advisable under the law;

(b) Detect, prevent and address fraud and other illegal activity;

(c) Respond to your requests for customer service; or

(d) Limit our legal liability or protect the rights, property, or personal safety of ourselves, any user of our Platforms, a third party, or the general public including as part of investigations.

ii) Business Transfer: If we sell or transfer part, or all assets of Oopsy the Clown to another individual or organization your personal information, and any other information collected through our Platforms may be among the items included in the legal transfer. The buyer or transferee will be required to honor our commitments outlined in this Privacy Policy.

iii)     Security Notice: In the unlikely event that we believe a breach of security has compromised personal information that is in our possession or control, we may notify you, if deemed appropriate, as expeditiously as possible via the e-mail address you have provided. You consent to our use of e-mail as a means of such notification.

Service Providers

We contract third-party service providers to facilitate the operations of our Platforms and on occasion, to manage the usage analytics information. These service providers are required to abide by the terms of this Privacy Policy, and as such may be given access to your information only as is deemed reasonably necessary, and if required to provide their contracted services. 

Information Storage

Information collected through our Platforms may be stored and processed in Canada, the United States of America, or any other country in which we or our service providers maintain facilities. We or our service providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. By using a Platform this platform you consent to the transfer of this information to Canada or to any other country in which we or our service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy. If you are located in Britain, the European Union, or other regions with laws governing data collection and use that may differ from Canadian law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.

Security of Your Information

We strive to maintain the security of information but cannot guarantee that information security measures are fail-safe or that our Platforms may not be accessed, disclosed, altered, or destroyed. We maintain technical and organizational procedures to keep information collected secure, including limiting the number of people who have physical access to our database servers and use of electronic security systems and password protections to guard against unauthorized access.

Links From Our Platforms to Third Party Websites

As a convenience to our users, our Platforms may contain links (“linked sites”) to other websites or apps, including content offered by third parties whose privacy and data collection practices may differ from ours (“Third Party Platforms”). We are not responsible for the practices employed by any websites linked to or from our Platforms including their services, information, or content. When you enter Third Party Platforms, you enter at your own risk and become subject to their terms of use and privacy policies rather than ours. We do not accept any responsibility for your use of linked sites. You assume sole and complete responsibility for any losses or penalties incurred as a result of entering a third-party platform.

We reserve the right, at our sole discretion, to revise this Privacy Policy at any time. Upon annual review, we periodically update and publish it on www.oopsytheclown.com for your perusal. We will not change how we handle previously collected information without providing notice and obtaining parental consent where necessary. You are responsible for regularly reviewing this Privacy Policy. Continued access to and use of www.oopsytheclown.com following any such changes or revisions means you accept its contents and will abide by its contents. As well you are encouraged to review our Terms of Use Agreement provided on this website.
